When is it good to pass legislation? Do we wait until we're absolutely certain that it will work, or do we in fact pass almost ALL legislation on a "try and see if it works" basis?

Well, that's a tough question that probably has a real quantitative answer, depending on your criteria for "work." Without knowing it, I still feel confident saying with near certainty that a minority produce the precise result we expect. Take economic policy, which might be one of the most important current functions of the US government (whether you think that is justified or not), for example. Though it appears to be far more quantitative than, say, social policy, it is still a bit of a mixed bag when forecasting. From a Libertarian perspective, I would say that's because the government can't predict the invisible hand of the economy, as Adam Smith might put it.
So while economists are sometimes able to forecast accurately for short durations, there is no sense in which we can enact economic policies with complete certainty of their impact; thus, we often take the approach of "try and see if it works" because there's really no other way to do it at the moment.
Of course, we do not just try any policy. Though we can't be certain that the future will resemble the past in some respect, we draw on our previous experiences to argue over which policies appear to be more justified for our future course of action.
