So both me and my wife work. We also run a home business which after 'business' related costs we clear about 1k a month.

My question is my wife makes about 1/3 of what I make so her check and the home business would not cut it as far as paying mortgage and shit.

If I were to get laid off would I still be granted unemployment based on the fact that I would need it to make ends meet or would they see my wifes check (about $250/wk) and the business (figure $250/wk) and say we are both employed and deny me?

I did try calling myself but after waiting on hold 40 minutes figured I would ask here in case anyone else had been through it before getting ready to call again Monday.

Not sure what you mean by "home business" and whether or not it is reported.

Home business is reported I basically run a very small internet company. Helps pay the bills but could never be an alternative for my day gig.

My company is kind of on the rocks now trying to get a loan to fun keeping new merchandise in the stores so I am just trying to figure out wtf to do.

We thankfully have some bank saved but with such a shitty job market I don't think it would be that uncommon to take 6 months to find a decent gig.

In Texas, and I mean in Texas, cause each state is different, unemployment is individual based, not household.

With that said, any income that YOU, and by you I mean YOU, claim on your W-2s will be considered income to the government, and will be grounds for denial of benefits.

Your best bet is to check you states unemployment benefits website or to call them.


Good luck, I was denied benefits because of a technicality and have been incomeless since early November.

Your wifes income means nothing when figuring your unemployment compensation. however, the business if in your name as well as hers, makes half of it your income. So it would be factored in how much you receive. If you become unemployed just find out if you can get your name removed from the business. Then it can't be factored as your income.

Of course every state has different specifics and limitation, but they more or less all should work on this same basic principle. If you have a feeling that there is good chance of you becoming unemployed, then find out what needs to be done to have your name removed from the business and in your wifes name as owner or if this maneuver would even disqualify it as income to begin with. I would assume it would, but don't hold me to it.
